Rental Conditions

1. Signing the Contract

The Contracts becomes valid by a written order, phone order or a direct meeting, with a written confirmation of the renter. The contract is valid without a signature of the hirer. Renter can be one or more Persons, they have to be named explicitly as renters in the contract. With orders for three days and more a down payment of 30% is required. Groups with an order for at least three boats have to make a down payment already for a one day order.

2. Rental Duration

The rental duration will be agreed explicitly and in written form between the renter and the hirer.  The time for a rental period of one day is the calendar day. An extension of the agreed rental duration has to be requested in time from the hirer and has to be approved from the hirer. When the extension has not been requested irregardless of the reasons the fee will be the double rate of a one day rental for all days exceeding the original rental duration. The prove of a damage can only be done by the hirer.

3. Rental fees and Payment

The rental fees are based on the currently valid price list. Down payments have to be done latest 7 days after the contract has arrived at the hirer, otherwise it becomes invalid. Final payments are to be done when the rented objects are claimed. For daily rentals the payment has to be done in cash.

4. Liability

In case of loss or damage of the rented objects renter and user are completely responsible. The renter has to pay the full compensation even when the reason for the damage are third party persons or weather conditions. Damage caused by the usage of the boats have to be paid as well by the renter. The hirer informs hereby explicitly that the boats and all add on material can only be used for driving for private reasons.

5.  Liability of the Hirer

Regress requests of the renter because of the contract are not valid. Exceptions are careless neglections of the contract be the hirer or by an employee of the hirer.

6. Cancellation of the Contract

In case that a renter has ordered a contract for two days and more or for more than one boat the following is valid: When the contract is cancelled 21 days before the start of the rental period 10 percent of the fee has to be paid. In case of less than 21 days but more than 5 days 30 percent has to be paid. In case of less than 5 days the full amount has to be paid.

7. Other agreements

The renter conforms that all users of the boats can swim. There is no liability of the hirer in case of any injury of the users. The users will be informed that they have to wear swim vests at all times. All rented objects have to be returned in a clean state, otherwise a cleaning fee of € 20,- has to be paid per boat. In case of ignoring some of  contract conditions or of some legal conditions the hirer can cancel the contract immediately without any return payment. In addition to this contract the rules and laws of this country "Verordnung über die Benutzung von Wasserfahrzeugen zur gewerbsmäßigen Personenbeförderung und zur gewerbsmäßigen Bootsvermietung auf den Gewässern Schleswig-Holsteins" valid since 30.04.1969

8. Finals

Potential non validity of single paragraphs of this contract do not have any impact on the rest of the paragraphs.
